These Terms of Service ("Terms") are an agreement between you and PeakBridger ("PeakBridger", "we", "us") governing your use of the peakbridger.de website, the PeakBridger Minecraft server network, and our associated Discord server (together, the "Service"). By visiting the website, connecting to the Minecraft server, or joining the Discord server, you agree to these Terms. If you do not agree, please don't use the Service.
Connecting to the server, browsing this website, or joining our Discord counts as acceptance of these Terms and of our Privacy Policy. We may update these Terms at any time as described in Section 14; continued use after an update means you accept the revised Terms.
You must be able to form a binding agreement under the law of your country to use the Service, and where required, have your parent or guardian's permission. Several staff roles carry their own minimum ages (for example, 14 for Support and Content roles, 15 for Developer) — see the Apply page for specifics. Discord's own minimum age (currently 13) also applies to use of our Discord server.

Breaking these rules can result in a warning, mute, kick, temporary ban, or permanent ban, at our discretion and without prior notice.
Meeting the published requirements for a rank (YouTube, Support, Content — Promotion, Content — Builder, or Developer) does not guarantee you will receive it. All applications are reviewed manually and may be denied at our sole discretion, even where every listed requirement is met. Ranks and staff privileges are granted at our discretion and can be revoked at any time, for any reason, including inactivity or conduct that reflects poorly on the network.
"Your content" means anything you create and submit through the Service — in-game builds, schematics, promotional graphics, videos, applications, chat messages, and ticket submissions.

Our staff enforce these Terms and any in-game or Discord-specific rules at their discretion. Moderation decisions — warnings, mutes, kicks, and bans — are final unless overturned on appeal through our Discord. We are not obligated to explain, justify, or reverse a specific moderation action.
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free. We don't guarantee the server's uptime, performance, or that any data (including scores, ranks, or purchased items) will be preserved. The live status widget on our homepage pulls data from a third-party public API and is shown for convenience only — we don't warrant its accuracy.
In short: we do our best to keep things running well, but nothing here is a promise or a guarantee, and you use the Service at your own risk.
To the fullest extent permitted by applicable law, PeakBridger and its owners, operators, staff, moderators, developers, and affiliates ("the PeakBridger Parties") will not be liable for any claim, loss, or damage of any kind arising out of or in connection with your use of, or inability to use, the Service. This includes, without limitation:
This limitation applies regardless of the legal theory the claim is based on (contract, tort, negligence, strict liability, or otherwise). Where liability cannot be excluded under applicable law, the PeakBridger Parties' total aggregate liability to you for all claims arising from the Service is limited to the total amount, if any, you paid us in the twelve (12) months before the event giving rise to the claim.
You agree to indemnify and hold the PeakBridger Parties harmless from any claim, demand, loss, or damage, including reasonable legal fees, arising out of your use of the Service, your content, or your violation of these Terms.
PeakBridger is an independent, community-run Minecraft server. We are not affiliated with, endorsed by, or sponsored by Mojang Studios, Microsoft, or Minecraft. Minecraft is a trademark of Mojang Synergies AB.
The Service links to, or relies on, third-party platforms — including Discord, our live-status data provider, and, where applicable, a payment processor. Your use of those platforms is governed by their own terms and privacy policies, and we're not responsible for how they operate.
We may update these Terms from time to time. We'll update the "Last updated" date above when we do. Material changes may also be announced on our Discord. Continuing to use the Service after a change means you accept the updated Terms.
We may suspend or terminate your access to any part of the Service at any time, with or without notice, for any reason, including a breach of these Terms. Sections that by their nature should survive termination (including Sections 9–13) will continue to apply.
These Terms are governed by the laws of Germany, without regard to conflict-of-law principles, to the extent permitted by applicable law — without prejudice to any mandatory consumer-protection rights you may have under the law of your own country of residence.
